GAMSTOP TERMS OF USE

Please read these terms of use (the Terms) carefully before using our website or the GAMSTOP service, as they contain important information regarding your use of our website, the GAMSTOP service, and the relationship between you and us. We last updated these Terms of Use on 16th February 2022.

Who We Are

We are The National Online Self Exclusion Scheme Limited (you may also see or hear of us being referred to as NOSES or GAMSTOP). We are a limited liability company registered in England and Wales. Our company number is 10504973 and our registered office address is 3 Greengate, Cardale Park, Harrogate, HG3 1GY.

What is GAMSTOP?

GAMSTOP is a free self-exclusion service set up to help you avoid online gambling, if you wish to do so. All businesses that are licensed to offer online gambling services to individuals in Great Britain must have and put into effect procedures for self-exclusion, taking all reasonable steps to refuse service or to otherwise prevent an individual who has entered a self-exclusion agreement from participating in gambling. Since 31 March 2020 all businesses licensed to provide online gambling services to individuals in Great Britain must be part of the GAMSTOP scheme as part of the licence granted to them by the Gambling Commission. By signing up for self-exclusion using GAMSTOP, GAMSTOP will help prevent you from accessing all gambling websites and apps run by businesses licensed to provide gambling services in Great Britain, including any new ones that may open in future. You can access the details of operators licensed by the Gambling Commission on the Public Register.

It is important for you to understand that GAMSTOP can only exclude you from engaging in gambling activities offered by operators who are part of the GAMSTOP scheme. We are unable to prevent you from accessing gambling activities that are operated by organisations which are not participating in the scheme. A full list of gambling companies participating in the GAMSTOP scheme is available here.

These Terms of Use

These Terms govern your use of our website and GAMSTOP, which is accessible via our website.

Please read these Terms carefully before you access our website or use GAMSTOP. We recommend that you print a copy of these Terms for future reference. By accessing our website and by using GAMSTOP, you will be deemed to have understood and accepted these Terms, which form a binding agreement between you and us.

Changes to These Terms

We may revise these Terms from time to time. We will try to notify you if we make any significant changes to these Terms, but it is your responsibility to check this page every time you visit our website or use GAMSTOP, to take note of any changes we have made, as they are binding on you.

Registering for Self-Exclusion

Although you can access certain parts of our website without having to register, in order to be able to use GAMSTOP to self-exclude, you will need to register for self-exclusion. To register, you will need to complete a simple registration process, as part of which you will have to provide us with the following information:

When you register for self-exclusion, you will also need to decide the minimum time period you wish your self-exclusion to last for (your Minimum Exclusion Period). The options we offer are:

You will be given the chance to review the information you have provided before you enter the verification process.

Once you have provided us with the information listed above, we will need to undergo a verification process. We currently use two third party verification service providers, TransUnion and Onfido, although we may choose to use different third party verification service providers in the future. For the TransUnion process you will need to answer a few questions. For the Onfido process we will need a photo of you and an official photographic ID document. Information on how your personal data is used for verification purposes is set out in our Privacy Policy.

ONCE YOU HAVE COMPLETED YOUR REGISTRATION, YOU WILL NOT BE ABLE TO DEACTIVATE YOUR SELF-EXCLUSION UNTIL THE END OF YOUR MINIMUM EXCLUSION PERIOD.

Once you have completed the steps above, we will activate your self-exclusion. Although we take care to activate self-exclusions as soon as possible, and generally do so within 24 hours, we cannot guarantee that your self-exclusion will take effect within this timeframe. The speed at which your self-exclusion takes effect on gambling operators' websites and apps will also be dependent on the effective operation of the gambling operators' systems, for which we are not responsible.

Your Self-Exclusion

During your self-exclusion, you will be prevented from accessing any accounts with online gambling operators registered with the Gambling Commission that match the details you have provided to us as part of your application. It is in your interest to provide us with accurate details consistent with those which you have used to set up accounts with online gambling operators. GAMSTOP may not be able to spot inaccuracies or other differences in account details, and we may not be able to prevent you accessing accounts you have created using, for example, email addresses that you have not provided to us as part of the registration process. GAMSTOP will operate on the basis of the information you have provided at registration and we will not be responsible for failure to spot errors made on your part.

If you have any withdrawable funds remaining in any online gambling accounts once your self-exclusion has been activated, the gambling operators of those accounts are required to return these funds to you. The details of how this will be done will depend on the operator in question and the return of such funds is not our responsibility.

We shall administer your self-exclusion as described in these Terms. You agree that GAMSTOP may use any personal data relating to you either collected during registration or otherwise and either collected directly from you or otherwise to the extent necessary for the performance of GAMSTOP's obligations under these Terms.

GAMSTOP is a tool to help you avoid online gambling. We cannot guarantee that GAMSTOP will always result in you being denied access to a specific gambling operator or gambling activity.

Your Personal Data

You will provide GAMSTOP all personal data requested when you register for GAMSTOP and self-exclusion. You may also provide GAMSTOP personal data when you contact the GAMSTOP Contact Centre or via your online GAMSTOP consumer account.

GAMSTOP will also receive personal data about you from gambling operators that participate in the scheme, for the purposes of completing regular checks and to run checks when you attempt to use these operators' gambling platforms. To undertake these checks, operators send their customers' data to our matching service, which checks this information against the personal data we hold about people who have self-excluded.

We may also receive other personal data relating to you directly from you or another source.

We may receive information from a gambling operator, individual or other source that indicates that an individual has been incorrectly matched as being self-excluded, when, in fact, they did not register for self-exclusion on GAMSTOP.

You agree that we may share personal data relating to you with and receive personal data relating to you from gambling operators that participate in the scheme where necessary for the performance of these terms and/or the statutory or regulatory obligations of operators.

Your Responsibility

You understand that self-exclusion using GAMSTOP is intended to be an aid to help you manage your use of online gambling websites. It is not intended to function as a replacement for willpower, is not foolproof and as mentioned above, we cannot guarantee that it will always result in you being denied access to gambling websites.

Your self-exclusion using GAMSTOP will be most effective if you do not try to work around the exclusion measures GAMSTOP has put in place. You agree not to attempt to register new gambling accounts, log in to any of your existing accounts, or in any other way try to circumvent GAMSTOP's mechanisms for the duration of your self-exclusion. You are entirely responsible for any actions you take designed to circumvent any self-exclusion registered with GAMSTOP.

You accept that GAMSTOP may not be as effective in circumstances where it has received inaccurate, incomplete and out-of-date information or where there are differences between account details. GAMSTOP may also not be as effective when you attempt to work around the exclusion measures GAMSTOP has put in place.

The End of Your Self-Exclusion

Your self-exclusion will not automatically expire at the end of your Minimum Exclusion Period, nor will we contact you to let you know that your Minimum Exclusion Period has expired.

At any time after your Minimum Exclusion Period has expired, you may via your Online Account or the GAMSTOP Contact Centre extend your self-exclusion for a further Minimum Exclusion Period of 6 months, 1 year or 5 years.

At any time after your Minimum Exclusion Period has expired, you may also choose to deactivate your self-exclusion. If you choose to deactivate your self-exclusion you must contact the GAMSTOP Contact Centre by phone. Your choice to deactivate will be subject to a minimum 24-hour cooling-off period, in which your self-exclusion will remain active.

As with self-exclusion activations, although we take care to deactivate self-exclusions as soon as possible, and self-exclusions generally automatically deactivate straight after the 24 hour cooling-off period, we cannot guarantee that your self-exclusion will be deactivated within this timeframe. The speed at which your self-exclusion is deactivated on gambling operators' websites and apps will also be dependent on the effective operation of the operators' systems, for which we are not responsible.

If you do not contact the GAMSTOP Contact Centre once your Minimum Exclusion Period has expired, your self-exclusion will continue for a further 7 years after the date on which your Minimum Exclusion Period expired. After this date your self-exclusion will be deactivated.

For a period of 7 years following the deactivation of your self-exclusion, (either by you contacting the GAMSTOP Contact Centre or automatic deactivation 7 years after the end of your Minimum Exclusion Period), we will inform gambling operators licensed in Great Britain that you have previously held an active self-exclusion with GAMSTOP.

Our Privacy Policy

Our Privacy Policy and our Cookie Policy will also apply to your use of GAMSTOP. Our Privacy Policy sets out the terms on which we process any personal data we collect from you or that you provide to us and our Cookie Policy sets out information about the use of cookies on our website.

We will hold personal data relating to you in accordance with our Privacy Policy, which includes retaining information relating to you for the duration of:

Accuracy of Information and Security

You agree that you will provide truthful and accurate information when registering to use GAMSTOP, that you will provide your details in the same format as you have or may provide them to licensed gambling operators, and that you will only register for self-exclusion on your own account.

YOU MUST NOT ATTEMPT TO REGISTER FOR SELF-EXCLUSION ON ANYONE ELSE'S BEHALF.

Registering on behalf of someone else, unless you are lawfully entitled to do so and authorised by them (for example, under a valid power of attorney) is a breach of these Terms and could expose you to legal liability to us and the person on whose behalf you registered.

Your Responsibility for Your Account

It is your responsibility to keep the information on your registration up-to-date. Failure to do so may result in your self-exclusion being less effective. If you would like to change or update any of the details on your registration (for example if you change your name or address), please do so via your online GAMSTOP consumer account or call the GAMSTOP Contact Centre to speak to us regarding any such changes. If you have changed your name, you will need to call the GAMSTOP Contact Centre.

You are responsible for maintaining the confidentiality of any information forming part of your self-exclusion registration.

Your GAMSTOP consumer account is your responsibility. You are responsible for maintaining appropriate confidentiality of your consumer account and login details (including password). You are solely responsible for all activities that occur under your account and for any access to or use of GAMSTOP by you or any person or entity using your account, whether or not such access or use has been authorised by you (except where such access or use was due to the inappropriate action or inaction of GAMSTOP).

You must immediately notify us of any unauthorised use of your account or any other breach of security. We will not be liable for any loss or damage whatsoever resulting from the disclosure of your account details by you contrary to these Terms.
